1. The term "Contents" or "Content" used herein shall mean and includes any and all information, data, text, software, music, sound, photographs, graphics, video, messages, materials, news, notices, articles, contracts, forms, documents, interactive features or other materials and information which may be viewed or downloaded on or through the Site. Contents shall also include any e-mail, messages, e-cards or any other information (including but not limited to any advertising or promotional material) sent by the Site to the User.
   "User-generated Content" shall mean any information, data, text, software, music, sound, photographs, graphics, video, messages, materials, news, notices, articles, contracts, forms, documents, interactive features, web-links/ hyperlinks or other materials and information which shall be provided, submitted, posted, displayed, shared, stored, uploaded or generated by the User on the Site.
2. Proprietary Information: No material from Trilogy or any website owned, operated, licensed or controlled by Trilogy may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that You may download one copy of the materials on any single computer for your personal, noncommercial use only, provided you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose is a violation of Trilogy's proprietary rights. For purposes of this Agreement, the use of any such material on any other website or networked computer environment is prohibited.
3. Representations:
   
   1. You agree that you are providing the Site with details regarding your mobile phone, e-mail, first and last name, street address, gender, occupation, interests and/or other personal information, which will all form a part of User-generated Content (described above). You also agree that Site will use such information provided by you for the purpose of verification, creation of your account (including your e-mail address and a password, which is used to protect your account from unauthorized access). Further, such information may be used for sharing/ allowing access to information/ entities/ OEMs/ persons/ services that you intend to receive/ be contacted and/ or view the uploads put up on the Site by other Users/ yourself.
   2. By registering with the Site, you agree to upload and view the Site (including User-generated Content). You can upload User-generated Content on your account that you desire to be accessible to other Users of the Site. The Site does not endorse any User-generated Content that is uploaded or transmitted by other Users of the Site. Site reserves the right, at its sole discretion to append any advertising materials to the User-generated Content and the User hereby expressly agrees to the same.
   3. You confirm and warrant that User-generated Content shall not be illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, Trojan horses, ‘time bomb’ software programs, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam".
   4. Users warrant that they have all the required rights to upload the User-generated Content and they shall keep Trilogy completely harmless from any claims, liabilities, obligations, damages or other losses on account of any User-generated Content. You must provide true, correct, complete and accurate information, whether the same concerns you or belongs to a third party. You expressly agree not to use the Site to: (i) harm any User in any manner either directly or indirectly; (ii) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Contents transmitted through the Site; (iii) disrupt the normal flow of the Site, or otherwise act in a manner that negatively affects other Users' ability to engage in real time exchanges or "stalk" or in any other manner harass another User; (iv) interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies or regulations of networks connected to the Site; (v) upload or transmit any material that is deemed derogatory with respect to the name, services or Contents relating to or provided by Trilogy; (vi) intentionally or unintentionally violate any applicable local, state, national or international laws.
4. Indemnities: You agree to indemnify and hold Trilogy, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the User-generated Content you submit, e-mail, transmit or make available through/ on the Site, your use of the Site, your connection to the Site, your violation of any of these Terms, or your violation of any rights of another User of this Site.
5. Subcontract: Notwithstanding anything contained hereunder and subject to these Terms, User agrees that Trilogy shall have the right to assign these Terms or any of the obligations hereunder or use subcontractors in performance of its obligations and services hereunder and, for purposes of these Terms, all references to Trilogy or its employees shall be deemed to include such subcontractors.
6. External Sites: The Site may contain links to other sites on the Internet that are owned and operated by third parties (the "External Sites"). You acknowledge that Trilogy is not responsible for the availability of, or the content located on or through, any External Site. You should contact the External Site administrator or webmaster for those External Sites if you have any concerns regarding such links or the content located on such External Sites.
7. Disclaimer: While Trilogy uses reasonable efforts to include accurate and up-to-date information on the Site, Trilogy makes no warranties or representations as to its accuracy. Trilogy assumes no liability or responsibility for any errors or representations in the Content/ User-generated Content of this Site. THE SITE DOES NOT CLAIM ANY SPONSORSHIP, AFFILIATION WITH, ENDORSEMENT BY OR ANY OTHER ARRANGEMENT WITH ANY OEMS. THE LOGOS/MARKS INDICATED ON THE SITE MAY BE TRADEMARKS OR TRADE NAMES OF THEIR RESPECTIVE OWNERS.

10. Miscellaneous: Any claim relating to, and the use of, this site and materials contained herein is governed by the laws of India. The courts at Bangalore, India, shall have exclusive jurisdiction. Further, these Terms or your use of the Site does not constitute any joint venture, partnership, employment or agency relationship between You and Trilogy.
